WAYMAKER services are offered for business and professional purposes. By purchasing a Business Operating Assessment, you confirm that you are acting wholly or mainly for purposes relating to your trade, business, craft or profession and that you have authority to purchase on behalf of the relevant business where applicable.

If you are not purchasing for business or professional purposes, contact us before placing an order. Nothing in these terms excludes rights that cannot lawfully be excluded.

The Business Operating Assessment is a diagnostic and advisory service designed to identify operating friction, priorities and practical next steps. The exact format may include review of information you provide, a scheduled assessment session and a resulting set of findings, priorities or recommendations.

Recommendations are based on the information available at the time and professional judgement. They are not a guarantee of revenue, profit, funding, business performance or any other commercial outcome.

The price and currency that apply to your order are shown at checkout. Payment is collected in advance through Stripe before the paid assessment journey is confirmed. A contract for the Assessment is formed when payment has been accepted and the reservation is confirmed.

Prices shown on the website are stated as the amount payable for the relevant service. Any tax treatment required by law will be handled as applicable to the transaction.

After successful payment you will be asked to choose an available assessment time. You should provide accurate booking information and complete any requested preparation before the session.

If you need to change or cancel a booking, contact us as soon as reasonably possible. We will reasonably accommodate rescheduling subject to availability. Unless otherwise agreed in writing, the Assessment fee becomes non-refundable once the assessment has been delivered. Before delivery, any cancellation, refund or revised booking will be confirmed in writing, taking account of work already performed and costs already committed.

If WAYMAKER cannot provide the Assessment and a suitable alternative date cannot be agreed, we will refund the amount paid for the undelivered Assessment.

You are responsible for providing information that is reasonably accurate, complete and lawful to share. You remain responsible for business decisions, implementation choices and obtaining specialist legal, tax, financial, employment or regulatory advice where needed.

An Assessment does not commit either party to further work. Any implementation, operating support, advisory retainer or other engagement will be agreed separately, including its scope, price, timing and any additional terms.

We will treat non-public business information you provide as confidential and use it for the purpose of delivering or discussing WAYMAKER services, except where disclosure is required by law or reasonably necessary to trusted service providers supporting delivery. You should not provide information that you are not authorised to disclose.

WAYMAKER retains ownership of its pre-existing methods, frameworks, templates, website content, branding and know-how. Unless otherwise agreed in writing, you may use assessment findings and deliverables provided specifically to you for the internal purposes of your business and may share them with your professional advisers where reasonably necessary.

General website content is provided for information and does not by itself constitute professional advice for a specific business. The website may use or link to third-party services such as Stripe, Cal.com, Supabase and Vercel. Those services may have their own terms and privacy arrangements.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation or for death or personal injury caused by negligence where applicable.

Subject to that, WAYMAKER is not responsible for indirect or consequential loss arising from reliance on website content or business decisions made after an Assessment. To the fullest extent permitted by law, WAYMAKER's aggregate liability arising from a paid Business Operating Assessment will not exceed the amount you paid for that Assessment.

These terms and any non-contractual dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply by law.

We may update these terms for future use of the website or future purchases. The terms that applied when a paid service was purchased continue to govern that purchase unless a change is agreed or required by law.
